Privacy Policy

WEST CREEK FINANCIAL values each customer and treat them with very high and professional standards, such that our customers can be worry-free about the security and confidentiality of their personal information. We strive to maintain the privacy and security of all information regarding our customers. This notice describes the privacy policy and practices followed by WEST CREEK FINANCIAL with respect to its business operations. By doing business with us each customer consents to the privacy practices described in this privacy policy.

  1. Customer Information We Collect. WEST CREEK FINANCIAL gathers all the relevant information on each customer’s application in order to provide services and the maintenance necessary to fulfill our business services as the law allows or requires us to collect. Such information will include a customer’s personal information, including public and non-public information, and non-personal information. Personal information (i.e., information about an identifiable individual) may be is obtained through the following sources:
    1. Application Information. We keep on file all personal information we receive from customers on any application provided by them. Such personal information includes: names, address, phone numbers, Social Security number, ITIN, employment information, references, income, and credit history, driver’s license number, financial information, etc.
    2. Transactions. WEST CREEK FINANCIAL keeps record of every transaction with our customers and with their related accounts. Such transaction information includes customer personal information such as dates of payments, date of inception of the lease, maturities, rental equipment’s, amount of transactions, lease number and agreement number.
    3. Consumer Report Agency’s. For each lease request or evaluation that we get from a Customer, we may request a report with such customer’s credit history, identity verification, banking information, stability report. We will keep the personal and credit history information about our customers and we may use it to evaluate future service requests in the future.We may also collect non-personal customer information – data in a form that does not permit direct association about a specific individual – in order to provide and provide and improve our products, advertising and services. Such information may include zip code, area code, gender, age, occupation, preferences, interests and favorites.

      We may collect, use and disclose non-personal customer information for any purpose, however, if we combine non-personal customer information with personal information, the combined information will be treated as personal information.

  2. Confidentiality. WEST CREEK FINANCIAL uses commercially reasonable precautions to protect and secure personal customer information from unauthorized use or disclosure. We maintain physical, electronic and procedural safeguards to protect and secure such information.
    1. Employee Right to use. WEST CREEK FINANCIAL employees have access to a customer’s personal information in order to provide business services to them. However, our employees access to such information is restricted and limited to their need and they only access the information to conduct a transaction or respond to customer inquiries. All employees are trained to respect member privacy. No one except our employees has access to the WEST CREEK FINANCIAL files storage, computers and systems.
  3. Sharing Member Information. In order to provide financial services to our customers, we may share a customer’s personal information with our third-party service providers (to the extent necessary to service such customer’s account), with financial institutions (to the extent requested by such customer) and where legally required, as further described below.WEST CREEK FINANCIAL does not sell customer personal information to third-party marketers offering their products and services.
    1. Sharing Information with Our Third-Party Service Providers. In order for us to conduct our operations, including servicing customer accounts or processing customer transactions, we need to share personal customer information with our service provid-ers, including the following: payment processing companies, insurance companies, collection agencies, contract employees, and credit reporting agencies, etc. We may share the following categories of information to third-party service providers, depending on the specific services provided.
      • – Account Information (type of accounts, account balances, transaction history).
      • – Member Information (name, social security number, address, account number).
      • – Transaction Information (dates, amounts, and types).
    2. Sharing Information as Requested by Customers. Customers can request that WEST CREEK FINANCIAL release such customer’s personal account and transaction information to other financial institutions for their own benefit. This allows the other institutions to obtain payment histories and payoff amounts.

      WEST CREEK FINANCIAL reserves the right to release this information to such institutions at its discretion and disclaims all liability associated with any such requested disclosure.

    3. Sharing Information Legally Required. We may share any personal information of customers in response to a lawful request issued by a court, government agency, or regulatory authority or as permitted by law in order to administer or enforce customers account. We may also share customer payment history and performance with credit bureaus. Credit reporting bureaus are governed by the Fair Credit Reporting Act and other local consumer reporting laws, which afford customer the right to confirm the accuracy of their credit bureau reports.
  4. Collection and Use of Bank Account Information: Once we extend a lease or agreement to a customer, WEST CREEK FINANCIAL will consider as a first option the bank account information provided by the customer and assure that the bank account is eligible for us to process payments against. In addition, as part of our information collection process, we may detect additional bank accounts under the ownership of the consumer.  We will consider these additional accounts to be part of the application process.  By applying, you authorize us to search for and evaluate bank accounts under your ownership for this purpose.
  5. Retention and Storage of Personal Customer Information. WEST CREEK FINANCIAL retain customer personal information for as long as necessary to fulfill the purpose(s) for which it was collected and to comply with applicable laws, including after termination of the customer’s relationship with us.
  6. Changes to Privacy Policy. This privacy policy replaces any previous privacy statements and notices from us about the privacy, security and protection of customer information. We may update this Privacy Statement from time to time. If we change this Privacy Statement, we notify customers of the updated privacy policy, which such notice may include posting the new policy on our webpage.
